I am a Tenant 3 months into a year contract, since just before moving into the property I have had a number of problems/issues with the Letting Agent I now want to take my complaint about their actions further then their office

While I realise the tenancy agreement is between myself and the LL (whom luckily is in agreement and may deal directly/privately with me) my deposit was paid to and registered by the LA so I wonder how I stand with getting my deposit back whilst the complaint is going on? (would I have it leave it until "the end of tenancy" as far as LA is concerned although I thought interest that accumulates would surely belong to the LA) I have also continued paying my rent through them as not sure of my LL position with them now whether he has to go through some kind of process to terminate his dealings with them which obviously I am not privy to

The DPS had advised I contact and take it up with the agency...so far they are not responding to my first letter I had sent I also understand that I have to wait 21 days after correspondence to their named contact at the LA before I can raise the complaint with the Property Ombudsman I guess what I want to find out if I can is that would the time frame have to start again if I were to send a further second letter?

As you know that your only contractual relationship is with L, it is against L that you enforce your tenancy rights (inc. recovering-back your deposit).

Thanks for replying Jeffrey;) not sure I get it as was told to persue the agency by the DPS as this is who was/is acting for the Landlord
Money has never gone through landlord hands although I am copying him on everything that has and will be sent

You could agree with the LL to start paying rent directly to the LL and not to the LA, this may wake up the LA.

If your deposit is protected (and I assume it is with your mention of having contacted the DPS), then you should have nothing to worry about in terms of getting your deposit back.
