View Full Version : L charged renewal fee but now refuses to renew

Hi we shortened our tenancy agreement to 6 months we were asked to pay the re-letting fee which we were happy to do as per our contract. We had two viewings both of which were eager to take on the property and we were hoping to leave early Nov. The landlord has now decided that they are not going to re-let the property as they want to undertake repairs over the festive period. Is it still right we are liable for the re-letting fee now they have decided not to re-let until January. Our agreement ends on the 10th December.

Hope someone can please advise if we can claim our fee back?

You are obliged to pay rent until 10th of December, if your landlord agrees to any amount less than that its a bonus.

Hi Krispy,

We are happy to pay the rent that's not the question sorry if it sounded confusing. It was the re-letting fee of over £500 that we have paid and the LL is now not re-letting until January as they want to carry out repairs/maintenance on the property.

Is your contract an AST in E&W?
What does it state regarding you're liability for the letting fee, e.g. you're only liable if you wish to end tenancy early?
Have you contacted the LL directly regarding return of re-letting fee?

My guess is the "reletting fee" is something the agent is charging not the LL. Are you sure it is in the tenancy agreement?

If it is the agent who is requiring you to pay this fee (and it is not in the agreement), ask why you have to pay it if you are not obliged to pay it under the terms of the current agreement.

On the basis you have not been served with a s.21 notice, you COULD (although perhaps not advisable) make things very difficult for the LL by staying put and paying rent past the end of the initial fixed term. If LL accepts the rent (i.e. he does not refund it), your fixed term tenancy will have rolled over to a statutory periodic tenancy, entitling you to continuous occupation unless and until the LL serves you with 2 months notice.
