As a borderline higher taxpayer, with a non-earning spouse, I read that we could apportion our BTL to utilise her annual allowances for both rental income and (if we sold) CGT.
I brought this up with our solicitor last week as we are in the process of re-mortgaging - he said there have been changes in the budget and advised me not to worry about it at this time, but to look at it later in the year.
I think he's wrong but is there some unambiguous quotation that I could give him to prove his fears are unfounded (or a similar unambiguous quote that proves me wrong - which I'll keep to myself!).
I was thinking of a 75:25 split.

There are some changes proposed ragarding the use of Trusts (mainly for IHT purposes) but I have not read anything in the press that suggests that they affect the transfer of properties to spouses. Having said this, I have not read the actual budget statement.
The transfer to the spouse of part or whole of the property could be by way of actually changing the Title Deeds in the conventional way, including changes to the mortgage if applicable, or more practically by way of a Deed of Trust.
The benefit of effecting the changes by way of a Deed of Trust is that they could be changed again if circumstances change without too much inconvenience.
