A friend sent in one months written notice for her flat, that apparently the agents did not receive, the landlord now has told the agent that he wants to keep her deposit for the months rent. can the landlord do this and what does the agent have to do with the deposit, apparently it is in a stakeholder account!!!!

Think Im right in saying that if the deposit is stakeholder, are you sure it is?, does it actually say that in the ast?, then the landlord can have nothing without your permission. Im unclear what happens in a stalemate, I assume that someone will mediate, maybe someone else here can help further.

How many times I post this I don't know. I wish people would use the search facility before lobbing a question on the forum. :rolleyes:

Appologies Paul, I did look at that thread but did not get a clear answer, can deposit be used as rent by the landlord on a stakeholder deposit? what happens in a stalemate?

Paul has been known to reduce grown men too tears, but for all his people skills, he is very knowledgable. In his article he states that a deposit "shouldn't" be used for rent as would affect any rental insurance. He does not state you Cant use it. Also he often talks about decisions being made by the courts, so in the event of a stalemate, I guess a court would make a decision.
