Under what circumstances, if at all, does having lodgers sharing a landlord's house (where he is part-time resident and has his own private bedroom and bathroom but kitchen and other facilities are shared) constitute an HMO?

The scottish executive webite says:
Your home may be a House in Multiple Occupation (an HMO) if:
1. at least three people live there; and
2. the people who live there belong to three or more families (If the owner lives there, they and their family are not counted); and
3. you share a kitchen, bathroom or toilet
It may be slightly different in England but if it is then you should check on the office of deputy prime minister website
