I wondered if anyone can help me out here.
There is a block of flats owned by a Management Co of which each of the residents is an equal shareholder - all of the flats are held on long leases.
There is a leak. It is entering Resident A's flat and it is 99% certain that it comes from Resident B's flat. Resident A is understandably unhappy.
Trouble is, Resident B will not talk to the managing agents. They have requested he remedies the problem, to no avail. They have given him notice that they wish to enter the premises and remedy the problem themselves, as per the lease. Again, no response.
I guess that the Man Co and Man Agents do not have the power to force entry if Resident B will not let them in?
Is there a solution here ?
