View Full Version : Maintenance Charge Demand

I have lived in my flat (1 of 3) for a couple of years and what maintenance has been done, has been paid for as it has been carried out. We have paid about £300 for insurance and accounts.

The Man Co has suddenly demanded £5,500 to be paid in the next fourteen days.

The Lease states
“The Management Company shall as soon as practicable after the first day of January in each year prepare estimates of the sums to be spent by it on the matters specified in Part II of this Schedule”

“The Leaseholder shall within 14 days of receipt of demand thereof pay to the Management Company the Maintenance Charge”

and

“Such sum as the Management Company shall determine as desirable to be set aside in any year towards a reserve fund”

The Man Co haven’t given any details of what they intend to spend the money but that any money not spent this year will be moved to the Reserve Fund.

Can they do this or do they need to comply with the Consultation on Major Works?
Or do they need to give me accurate proposals and estimates of what they intend to carry out?

Are you a member of the management company?

Ask the management company what they intend to spend the money on and when.

I am not a member of the Man Co that is sown up by the other two Leaseholders. Found out from the previous owner they wouldn't let him join either.

When asked they just say the money will be spent on necessary maintenance and whats left will be put in the Reserve Fund.

If they have not followed a proper S20 consultation process (and it appears they haven't), then your liability is limited to £250. However, this might send the Mgt Company under (who is your landlord?) which wouldn't really help you much.

Options - Ask to become a member.
- Don't pay (or pay only £250)
- Some other sort of negotiation.

£5,500 is huge and excessive. I really wouldn't pay that.
