View Full Version : Detached property- neighbour's garage is now attached

I have recently bought a detached property to rent out. One of the agents today made an interesting point in that the adjoining property has build a garage that attached to my detached property. Are they allowed to do this to a detached house?

I know its not strictly a rental question, but prospective tenants are viewing the property and falsely thinking that the garage is mine because I have a detached house when infact it belongs to the adjacent corner property.

Any advice or pointers most appreciated.

I do apologise this is not a strict rental question, but I figured this is a good place to start.

As next door's garage is receiving support e.t.c from your house, your neighbours should have obtained at least written permission from your predecessors for the garage to be errected as your property has been changed from a detatched property to "link detatched". It might be worth mentioning it to the solicitor who did your conveyancing, but as the garage was presumably there when you viewed the property I expect it will be a case of "sold as seen"

You no longer have a detached house!

Did the neighbours have planning permisssion? Did they have the previous owners consent? You may have an action against them but need to get a solicitor to review the relevant documentation.

Personally I always do my own conveyancing as its safer! The procedures and checks a solicitor undertaskes are straightforward, but they never see the property so would not know to ask questions like "have the neighbours got permission for that garage?" And you innocently relied on them as experts to protect your interests so did not raise the question either!

Oh bugger!

Where do I start? Didn't fancy paying solicitors fees again. Can I get records of planning permission from somewhere?

The local council are able to provide all copies for a fee (£15ish). If permission not a long time ago may be on your council's website.
