View Full Version : AST reverting to Periodic tenancy

Questions:

1. In order for an AST to become periodic at the end of the fixed term, does there need to be a clause in the AST agreement to this effect?

2. Even if there doesn't need to be a clause, is it a good idea to have one to make the tenant(s) aware of what will happen if they decide to stay on at the end of the fixed term, notice periods required on both sides etc?

3. If such a clause is either required or a good idea, any suggestions on how it should be worded?

No, there is no need for any clause. In my introductory letter to new tenants I tell them what will happen at the end of the fixed term of their AST (i.e it will become a statutory periodic one) and the changes that occurr as a result of this.

Under the UTCCR's it is considered pertinent to advise the tenant in advance of their tenancy what happens at the end of the fixed term and their statutory rights accrued thereafter. It is also good practice to enquire of the tenant well in advance of the end of the fixed term whether they might like to "request" a further fixed term AST, or that it will become periodic in the event of no S.21 having been served.
