Hello I was wondering if anybody has any helpful advise for me.
I've been letting my flat out through a letting agent for the last three years and until recently had few problems. The letting agent in question is a NALS member and works on a basis of tenants paying 6 months of rent in advance. My last tenant was due to move out in August 2008 and I was told by the letting agents he would not be renewing his tenancy and that I could pick up the keys and move back in. To my amazement I entered the property two weeks after he should have vacated and found the tenant was still living there. What then followed was a rally of conversations between myself and the agents which ended in me instructing them to take legal action. They have been so unhelpful in this whole matter and they have left me too sort this mess myself. I have finally got the tenant evicted 5 months latter again with no help from the agents. My question is this; My ex-tenant seemed to know what he was doing and I have my suspicions that he has done this before as he knew rights and exactly when to vacate. I employed the letting agents to vet my tenants, however when I have asked them for the evidence that they have done this they hide behind data protection laws. Is there any way I can find out if they have done the necessary checks and if not can I try and claim my cost from them?:mad:
