View Full Version : Pigeons and falling aerial

hello Guyz,

As you probably know we live in a single block of 5 flats. It has a flat roof.
We have had an infestation of pigeons squatting on our roof for some yrs now.
We wrote to the relatively new landlord about this problem about 16 months ago, with no response.
The birds perch on the roof especially by the common area stairway, and deficate all onto them. Also all over the balcony common area, making it pretty slippery.
Can we complain to the Landlords about this ? and are they responsible to try to do something to prevent this ?
Also our aerial is down, is the landlord also responsible to fix this ?

PS. Just updating you guys on the "car park" issue. so far Landlord has not done anything.

As an AST tenant, or something similar, you need to look to L who has a duty [s.11 of LTA 1985] to keep the structure in good repair.

No doubt the LL will ignore this complaint along with all others over the past 2yrs.
Can we give the LL a time limit now to repair the aerial ?, and if he doesnt fix it, can we get a contractor to do it oursleves and deduct it from the rent ?

its not life threatening stuff over the aerial l know, but, my parents hardly go out now and do love their TV. What would be a resonable time to give the LL's a chance to come and refix/replace our aerial ?

Should we just quote the act: [s.11 of LTA 1985] to him with reference to the pigeons pooing all over the stairway and balcony area ? informing him that he must comply with that act by such and such a date or we will threaten him with court action ?
l can't see us ourselves being able to carry out preventing the pigeons landing on the edges of our flat roof.
We think the solution would be to erect thin metal mess fencing along the edges of the roof to stop them sitting there and pooing down in our direction.
