Ok, bit of a wierd question, but is there any rules regarding the hours that builders can work.

I live in a flat above 2 shops that are having a lot of renovation work done, and the builders kindly decided that at 6.45 this morning they would empty all the rubbish out.... and they wern't the quietst bunch! I have to say I was not impressed, even if it was only half an hour, it was my sleep time!!!

Just wondered if there was rules regarding when they could work.

Secondly they have been smoking, is this allowed, or would this come under the smoking ban as it is a communal area?!

I don't know whether there are laws/guidelines governing working hours of builders - presumably you mean from the point of view of disturbing people in adjacent properties, (rather than for their own wellbeing?!). Your local council EHO might be able to advise.

However, have you tried contacting the site foreman/company manager or whoever is in charge of the work, with your grievance? I agree with you that making a racket at 6.45 am. is unreasonable, but they may just not be aware that you're being affected (especially if they have Radio One on at 70 db! They may not even be aware of your existence). They should not be smoking in a communal area (or even on site, as it is classed as a workplace) I believe. Ask them not to.

Cheers for that, will contact the council Monday morning.

They are fully aware of the residential status of the building, and are just being inconsiderate ba$*&$ds!!!!

Think I may struggle as the building landlord seems to think that he can smoke in his shop and communal areas at his own free will. Rather arrogant imo!

Well I have just spoken to the landlord and he has "apologised" and seemed unaware of how early thay were here saturday morning.

I don't fell strongly about the smoking although I have mentioned it to him and he seems to think that it is ok for the builders to smoke as it is a "building site". Surely this would still come under place pof work, hence prohibiting smoking?!
