Hi,
I have a query which I hope someone can kindly assist me with.
Last June 16th I let a house to two joint tenants. The tenancy was for 12 months with a two month landlords termination clause which kicked in after 6 months (wording: "The landlord may give to the Tenant two months notice in writing to terminate this agreement, such notices not to become effective until six months of this agreement have completed")
The tenants both signed receipt of a notice requiring possession dated 16th June 2004 (day one of the AST) which required notice on 15th December 2004
The current situation is this. One tenant appears to have disappeared. The other is still in the house but has ceased to pay rent and avoids all contact with me (notes left, phone and text messages ignored, etc). I did manage to contact him by phone ten days or so ago and he promised to send a cheque that day but nothing has been received, so I assume he is not intending to or can't pay.
So I want to start eviction proceedings.
The question is, is the notice requiring possession on 15th December 2004 valid or do I need to serve a new notice?
Also, would it be better (quicker) to seek a possession order on the NRP or for non-payment of rent (they'll be two months in arrears later this week). I have evicted successfully using NRP before but not non-payment of rent.
