Hi

first time poster so forgive me if the query is an oft repeated one.

I have a business tenancy of a property in Belfast. (hairdressers) The lease was for a term of 9 years from 1996 which has now come to an end. The property is in disrepair and the lessor has offered to sell me the premises.

I wonder, however, if i am entitled to any compensation under the business tenancies (NI) order 1996. The Landlord has served me a Notice to determine the tenancy under section 6 of the above order. I'm assuming it essentially mirrors the English provisions.

If I am entitled to any compensation I'd be looking to have that compensation off set against the proposed purchase price.

Any confirmation of whether or not im due compensation would be gratefully received

I think the Business Tenancies Act (Northern Ireland) 1964 does largely mirror the Landlord & Tenant Act 1954, however, with regard to compensation I think you may be thinking more in terms of Defective Premises (Landlord’s Liability) which I believe is covered by a different piece of legislation.

You need to refer initially to the terms of your lease and yours v your landlord’s obligations regarding repairs. I think an important factor would be, did you pursue this matter during the term of your lease?

I think you need specialist advice if you wish to pursue this now, so consult a good property lawyer in Northern Ireland. The other factor worth considering is, would this prejudice the proposed sale?
