Paying rent but not living there?!?!?!?

Hi

please could someone help me in this matter, i am starting to panick, my tenant is currently in a 12 month tenancy agreement for a flat of mine, it ends at the end of january.
he has recently moved out has been living somewhere else for the last month, the flat of mine has been left in very good condition, and although he owe's me 2 months rent, does he lose the deposit???
it does not state in the agreement that he signed that if he moves out early he will lose the deposit.

please help

I would suspect that any arrears will be subtacted from the deposit, it is quite usual for tenants to pay the last months rent with the deposit.

ok so if the tenant miss paid 2 months rent...

(november + December )

and the flat is in a perfect coniditon.

the deposit is 1 months rent plus 100..

by law what does he have to pay??

If you are not bothered about chasing up the balance you keep his deposit and he would have to take you to court to get it returned at which point you would counter sue for the missing 2 months rent.

If you were bothered about chasing up the balance you would take him to court for the 2 months rent and he would counter sue for the deposit.
