View Full Version : Leasehold flats- 71/77 yrs. unexpired- extension Notices

I have two flats that require a lease extension. I have sent an offer to both Freeholders, niether has given me an answer on the price, so I would like to issue a s.42, just to hold the term left which is 71 and 77 years unexpired.

What do I need to send to issue this notice?

A section 42 Notice needs to be served (I have sent you one by e-mail) it should then be sent by recorded deilvery

Ensure that the Notice offers a credible premium (= price) for the new lease(s).
There was a Court case report in which a ludicrously-low premium offer was HELD to invalidate the Notice in its entirety.

Also, make sure you are fully aware of the deadlines involved. There are many, depending on what stage you are at during the process. If you miss any of the deadlines, your notice will be deemed withdrawn, you will end up paying the freeholder's reasonable legal and valuation costs to the point the notice is deemed withdrawn AND you will have to wait for 12 more months to pass before you can serve another notice.
