Draft Regs are now out re: selective licensing and facilities and management of HMO's
They make interesting reading:
ODPM - draft HMO regs under Housing Act 2004 (http://www.odpm.gov.uk/housing/consult)
Management Regs basic and fairly similar to existing - but duty proposed for HMO managers to ensure electrical installation is tested at intervals of no more than 5 years
(these are Draft regs - so may change)
Note:
Local Housing Authority - Do not now have to serve notice - can prosecute and/or take action under Part 1 of Act (Housing Health and Safety Rating System - which replaces fitness standard).
A person who fails to comply with these Regulations commits an offence.
Currently a notice has to be served and the offence is 'wilful non-compliance' with that notice
