View Full Version : Property Management Firm (Factor) Not Doing Their Job - Help!!!

Hi,

This is my first ever post on here – about time too as I have been a Landlord for 5 years.

I am looking for some advice on how to deal with a Property Management firm (or Factor).

As many on here may have experienced, these types are a bit arrogant, aggressive and don’t really do a lot for their money. This annoys me and this is why I am here.

Obviously if you are not satisfied with a Factor then it takes a lot of time and organisation to get new factors in – and don’t they know it!

My latest problem is that I have been TOLD that a painting job to the tune of £800 has been arranged and is scheduled to be carried out in the near future.
I queried this, asking why it hadn’t been put to a vote and why the job had only been quoted on by ONE Contractor.

The response was the usual arrogant stuff referring me back to the Deed of Conditions and saying that the Contractor in question was chosen because it was unlikely they could get a cheaper quote. Apparently it is so cheap because the work will be done with ladders – another can of worms but lets not focus on that for now.

I intend to query them again on the basis that I feel this should be put out to the vote and also because I feel they are not acting in the clients interests by only seeking one quote. To be honest, I suspect either laziness on their part or perhaps even a conflict of interest in respect of the Contractor they have chosen.

My question is, are there any rules and regulations in place that compel Factors to put such jobs to the vote. Also the same in respect of how many quotes they are obliged to get.

"Factor" is a Scottish legal word. If this property is not in E&W, most LZ members wil be unable to assist you; Scottish law is different.

Although I am in Scotland, please feel free to make comments based on E+W law as I'm sure many of the principles are the same.

I'm really just looking for a starting point here.
