View Full Version : Enfranchisement - who deals with negotiations?

Hi,

If I were to enfranchise, who is best to carry out negotiations with the Landlord? As many solicitors, surveyors and project management companies offer to do this! I am assuming a surveyor would be best to defend their valuation? How common is it for a valuation to have to be settled by an LVT?

Procedure for enfranchising houses should be:
a. informal negotiations via solicitors; failing which
b. formal Notice of Claim served by solicitors, plus further negotiations; failing which
c. formal negotiations between surveyors; failing whcih
d. LVT application.

Steps a and c are optional. Step b is essential pre-requisite for step d.

Procedure for flats (lease extensions or collective enfranchisement) is similar
EXCEPT that formal Notice (step b) has to propose a purchase price/premium.
