This isn't a question but something you can all use for up to date information on the above, or to give it its full title the Tenancy Deposit Scheme for Regulated Agents (TDSRA).

Lawrence Greenberg has written a splendid article in the February/March edition of "the estate agent" about how the scheme intends to operate. At £3 it's a good buy! It also has another article by Marveen Smith about how not to get caught out as an agent concerning unfair tenancy terms. A tenant won damages of £1,500 on top of having used the rent money to effect repairs when the AST stated the tenant must not set-off repairs against rent. The judged ruled it was an unfair term so the landlord really collared it, losing not only rent but effectively a fine too!. Who had a very red face?.......yes! the letting agent.

Sorry, to get back to the point...

Lawrence sits on the Interim Management Board that will eventually be replaced by a Board of Directors. The scheme is at the moment voluntary until the government's detailed proposals become clear. It costs £312 a year per office! The government aim to implement this part of the Housing Act 2004 by April next year - but don't bet on it!
