If an inventory was never made how can a landlord legally withold depost on the basis of damage or theft? If there is no inventory, no written proof, how can a landlord turn around and claim anything?

He can't really. If your landlord is withholding your deposit, write to him reuesting it back within 7 days, stating you will go to court if it is not returned.

Fill out a form from Moneyclaim Online (https://www.moneyclaim.gov.uk/csmco2/index.jsp) and send it off as soon as the 7 days expires.

It is very difficult. However remember that although an inventory is the standard and best form of proof, this does not mean it is the only form of proof.
