View Full Version : Lease covenant re carpeting- enforceable?

I have a regulation within my leasehold agreement that states "The floors of the flat excepting the bathroom and kitchen shall be completely covered with fitted carpet and suitable underfelt or other materials acceptable to the landlord except when the same shall be removed for cleaning repairing or decorating the Flat or for some other temporary purpose"

The directors of the freehold (there are 5 and there are 20 shares in the freehold, of which I have one), have refused to renew my lease based on the fact that I have laminate flooring in the lounge and hallway (the bedrooms are carpeted); the laminate flooring is laid upon plywood and a layer of foam and I have rugs in the lounge room.

I have not had any complaints from the tenants below and I would like advice on whether there is precedent for this and if it is reasonable to expect the freehold to accept the state of flooring as I have described

"or other materials acceptable to the landlord" did you get permission to put the laminate down? you did know about this when you did it didn't you?

by what method are you extending your lease?
