View Full Version : Lease extension; freeholder's served no counter-notice
In the middle of going down the statutory lease extension route. Have sent all the relevant correspondance to the freeholder and now he has missed the deadline for counter notice. Can anyone tell me if the Vesting order we now have to apply for will be in our favour and therefore the freeholder has to accept our terms? Think this is the case just wanted clarification on the matter! Thanks Linz:)

1. You presumably served Notice under s.42 of 1993 Act.
2. L has to counter-serve under s.45.
3. Failure by L triggers rights under s.49(1), entitling T to apply for Court Order. T's application has to be within six months from latest date for L's counter-notice [s.49(3)].
4. Court will order terms of transaction.
