View Full Version : How/When do serve notice? Help!?

:confused: Hi again people.. im fairly new as a landlord ( and every step is a mine field at the moment)!and would appreciate any help on this matter.

I have a tenant with a 6 month tenancy agreement from 23.01.05 to 23.07.05.
My question is...after this time, when would i serve a notice for possesion, if she no longer wants to remain ...(Or does it not matter whether she remains or not?! )...
Would it be served anytime during the tenancy agreement and expiry dated 22.07.05? This means she would have to be out for this date..right?!
Or can i only serve it at particular time?

A section 21 notice can be served at any time during the tenancy.It is not uncommon to get a s21 notice at the beginning of the tenancy.You must sort out whether the tenancy ends on 22/7/05 or 23/07/05 and get this right on the notice if you want to repossess (or renegotiate) as soon as the tenancy ends.It will be clear from the tenancy agreement which of these dates is correct.You need to give two months notice whenever you serve the notice.I hope this is helpful to you.

To add to what Andy Parker has posted, the important bit is the length of your AST which depends on its wording. If it states that it is valid for a period of six months from 23.01.05, then your section 21 notice should expire after 22.07.05. If however your agreement states that it is granted on the 23.01.05 and expires on the 23.07.05, then it is valid for six months and a day, thus your section 21 notice should expire after 23.06.05
