I have heard that if the rent is above £25000 per annum that a landlord cannot go for possession under S21 as the tenancy is outside statutory law. Does anybody know if this is correct?

Yes. it is. A new residential letting at > £25 000 is entirely outside the Housing Act 1988, so the Act's procedures (e.g. s.8, s.21) do not apply- nor do Deposit Protection requirements.

L has contractual and common-law rights against T, of course, unconstrained by that Act.
