Right over a year ago we signed up with a letting agency in Birmingham,Bluegate properties who have now gone belly up and declared themselves bankrupt.
Since this we have started to pay our landlord each month and we have had nothing but problems.

He put a extension on the property whilst we were living here and we were very badly inconvienced we were without kitchen for 3 days,bathroom fo one day and without all electric,gas and water for numerous occasions throughout.

He knocked of £75.00 for each month for the trouble.(2 MONTHS)

But £75.00 did not cut it...

We had to eat out for 3 days,do all the cleaning and then the inconvience and all the heat we lost when they had doors open all day and knocked walls out etc.
The noise,the stress,we were also not able to use our backroom throughout the whole extension,nor the garage nor the rear garden.

Also the cost of the electric for the 8 weeks they were using off our supply.

Also to add to this our deposit is not protected by a tenancy deposit scheme as we signed up last feb 2007.

But we are not in a current contract just on a rolling contract.

But to make it worse my landlord now says my deposit is with the agent and is not his responsability.

Where do i stand as to be very honest the man is a conman and we are looking elesewhere.

But i will do what it takes to get this sorted.

Also forgot to mention the gas safety cert ran out last month and despite reminders its still not been done.

This feels like illegal eviction to me.

But £75.00 did not cut it...have you told him this?

But we are not in a current contract just on a rolling contract.all contracts run onto a periodic basis if another contract has not been signed - your rights are still the same

Where do i stand as to be very honest the man is a conman and we are looking elesewhere.where do you stand as it what? do you want more compensation? if so then write a letter to your landlord - see what your next electric bill is compared to the previous ones so you can prove extra usage, state your case clearly and hope you can appeal to his better nature.

But i will do what it takes to get this sorted.

Yes he did discuss this intially and he told us that the work would be completed in 3 weeks,however this was a lie as the builders have since told me they told him 7-8 weeks.

But £75.00 did not cut it...have you told him this?oh yes we did,it turned into a heated debate made worse by his very basic knowledge of English.

Should it not be protected now i requested in last April and now the contract has run out?

My contract is with the landlord but we went through the letting agent they tell me they forwarded the deposit to the landlord.

I have already reported it as when he visited the house last week i told him it was a legal requirement and he said he would do it in his own time,but i told him it was a legal requirement and told him he could get a 6K FINE he laughed and said thats nothing and said he does not care!
I have two children in the property and i am at my wits end as all this is the latest of a serious catalogue of problems already being investigated by Birmingham City Council such as leaking roofs,damp etc.

I am looking at taking to court for breach of contract and also for the inconvience and also looking at taking a criminal case againist him and civil for illegal eviction.

I know this may sound extreme but he really is an idiot motived by money only.

With regard to the Gas Safety Certificate running out --

Report your landlord to the Housing and Safety Executive (HSE): http://www.hse.gov.uk/enforce/index.htm

immediately!

They come down hard on errant landlords, and it sound like this one deserves all he gets.
