The UK Housing Act 2004 involves one of the biggest changes for landlords for many years and most of its provisions will be enacted in April 2006. We continue this series on the Housing Act with a primer (Part 2) on the new Tenancy Deposit Schemes (TDS) due to be introduced in October 2006. There will be two types of scheme: a “custodial scheme� where a third party will hold the deposit and an “insurance scheme�, where the deposit is held by the landlord, but in the event of a dispute, the landlord pays the monies into the scheme pending arbitration (ADR) or court resolution of the dispute.

This January 2006 issue is the second Newsletter we have devoted to the new Tenancy Deposit Schemes (TDS) which are due to come in to use in October this year.

No doubt there will be more information to come about the schemes as the ODPM are still at the stage of consultation on some matters (see above) and scheme administrators remain to be appointed.

It’s still unclear exactly how the private DIY landlord will be accommodated in all of this.

Landlords using agents may know that ARLA, RICS and the NAEA already have a scheme in place—the Tenancy Deposit Scheme for Regulated Agents (TDSRA.)

There’s no doubt that deposits are the biggest cause of problems and disputes between landlords and tenants and in particular tenant advisory bodies such as Shelter and the Citizen’s Advice Bureau have lobbied hard for this.

Let’s hope that the scheme can be made to run smoothly and efficiently and to the benefit of both landlord and tenant. Editor.
